Subject matter of the contract
1.1 The General Terms and Conditions (GTC) govern the business and legal relationship between you and Excitement.ch AG in Spreitenbach with regard to the services offered.

Conclusion of contract
2.1 The contract between you and Excitement.ch AG is concluded upon acceptance of your booking, regardless of the form of the booking. From this point in time, the rights and obligations, including the GTC, apply to both parties.

2.2 The person making the booking is responsible for the contractual obligations - also for the persons registered by them.

Change or cancel an application
3.1 The following fees will be charged for last-minute cancelations:

  • Cancellations up to 2 days (48 hours) before the match are free of charge.

  • Cancellations made between 24 hours and 48 hours before the match are subject to a cancellation fee of CHF 60.

  • If you cancel your game less than 24 hours before the appointment, the cancellation fee is CHF 80.

  • In the event of a no-show for the match, the cancellation fee is CHF 100.

Cancellations must be made in writing via our contact form on our website or by e-mail. In the event of illness, accident or similar unforeseen events, bookings cannot be canceled free of charge. At least 2 players must be present at the start of the game. If this is not possible, you must provide a replacement yourself or otherwise pay the cancellation fees incurred.

3.2 The following fees will be charged in the event of team events being canceled:

  • Cancellations up to 5 days before the event (>120h) at 25% of the total price quoted excl. any VAT (including any drinks reception)

  • Cancellations less than 5 days before the event at 50% of the total price quoted excluding any VAT (including any aperitif)

  • Cancellations less than 24 hours before the event or no-shows will be charged at 100% of the total price quoted (including any drinks reception).

3.3 It may happen that we have to cancel a booking for organizational or technical reasons. The person making the booking will be informed immediately by e-mail or the telephone number provided. In this case, the booking person is entitled to a voucher in the amount of the fee paid or a refund of the price paid. There is no entitlement to any other compensation for expenses or damages incurred as a result of the cancellation.

3.4 If the event cannot be held due to force majeure, there is no entitlement to a refund of the fee paid or compensation for expenses or damages incurred as a result of the cancellation. These are events that we could neither avert nor foresee (e.g. earthquake, fire/water damage, prolonged power failure or equivalent events).

Services
4.1 The details of the services provided by Excitement.ch AG can be found in the descriptions on our website. The services start after the customer has arrived at our location. The person making the booking is responsible for the timely arrival of the group at our location. If the group arrives late, the service can only be provided at a reduced time on the booked date. In the event of delays of 30 minutes or more, the game can also be canceled. There is then no longer any entitlement to this or a replacement service.

However, we will endeavor to find a satisfactory solution for both parties on site.

If a group does not appear on the booked date, there is no entitlement to a refund of the fee already paid.

Terms of payment
5.1 As soon as a booking is confirmed (regardless of the form of booking or confirmation), the fee must be paid. The booking fee will be paid on site and before the game. In the event of early cancellations, please refer to the cancellation policy.

Conditions of participation
6.1 The escape games of Excitement.ch AG are unsuitable for people with discomfort in dark or confined spaces, people with claustrophobia or the like. More information can be found directly at the escape games.

6.2 The age limit for the individual games can be found directly on the homepage. Please note that identification may be requested on site. If the children are younger than the age limit specified by us, a parent must be present during the game. We accept no liability if the child later reports a negative experience.

Terms of use of the service
7.1 Players must follow the instructions of the game manager and sign a disclaimer on site.

7.2 Eating, drinking, smoking, vaping, photography, audio or video recordings of any kind are not permitted in the game rooms and in the hallway. Photographs may be taken in the lounge in consultation with the game director.

7.3 All players undertake not to publish, disseminate or pass on any information about the puzzles, items, furniture or other details about the specific content of the game.

Liability
8.1 The players themselves are fully liable for damage to furniture or equipment caused willfully or negligently.

8.2 Insurance is the responsibility of the participants.

8.3 Excitement.ch AG accepts no liability for direct or indirect damages such as injuries of any kind, losses or similar. Excitement.ch AG also accepts no liability for services provided to third parties.

Photo / video - game surveillance
9.1 Cameras are installed in our gaming rooms. These serve as technical support in order to provide the service. The resulting image and sound material is not stored, used or passed on.

9.2 In the course of our service, a group photo will be taken after consultation with the participants.

Excitement.ch AG reserves the right to publish these photos on its homepage or social media such as Facebook or Instagram, unless this is prohibited by the customer.

Changes to the GTC
11.1 The GTC can be changed by Excitement.ch AG at any time without prior notice. The current version shall apply.

Implementation of official orders
12.1. Excitement.ch AG must implement mandatory official orders. This also includes those that contribute to the management of pandemics (such as coronavirus). If the federal government or canton requires a certificate and control obligation or mask obligation, this obligation also applies on the premises of Excitement.ch AG. Persons who do not comply with the instructions may not be admitted. When the booking is made, the rights and obligations in accordance with these GTC apply. The cancellation conditions according to paragraph 3 remain valid.

Place of jurisdiction
13.1 The place of jurisdiction for any disputes is the registered office of Excitement.ch AG. Swiss law is applicable without exception.
